The teachings of Swami Vivekanand constitute a strong argument for the Uniform Civil Code (UCC) which is recommended in Article 44 of the Constitution of India, Additional Solicitor General Sanjay Jain said on Wednesday.
ASG Jain, who was speaking at an event to mark Swami Vivekanand’s birthday, pointed out that “character building”, which is one of the Indian philosopher’s teachings, was based on a system global and uniform values, and wondered if a commitment to the nation and the Constitution could be instilled in the younger generation without a commonality of values.
The Senior Advocate was speaking on “The Teaching of Swami Vivekanand and the Constitution of India” at the event organized by the Delhi High Court Unit of Adhivakta Parishad.
The lead attorney said Part IV of the Constitution, which lists “our purposes” in the form of guiding principles, cannot be achieved without “the formation of character”.
“Can we instill any kind of commitment in GenZ – the current generation as we call them – to our nation in general or our Constitution in particular, unless our character building process is based on a uniform and inclusive value system with the community of good values derived from all denominations and religions?
“How do we bring this uniform value system, with conflicting civil codes from different religion-based legal charters into everyday affairs? 44 and emphasized by the Supreme Code in various judgments,” the lead attorney said.
ASG Jain said the Constitution itself is a by-product of “awakening” one of Vivekanand’s teachings which provided for equality before the law, avoided discrimination based on religion, race, caste or sex and protected the right to life and liberty.
Our Parliament and the Supreme Court have ensured that this part of the “rising and awakening”, reflected in the basic structure of the Constitution, remains intact, he said.
